END USER LICENSE AGREEMENT for the Auto Social Poster plugin ("ASP") created and/or edited by Interactive Gambit LLC PLEASE READ THIS LICENSE CAREFULLY. This end-user license agreement ("EULA") is a legal agreement between you (an individual or a single entity) and Interactive Gambit LLC for all copyright with respect to ASP. By installing, copying, downloading, accessing or otherwise using ASP, you agree to be bound by the terms of this license agreement. 1. GRANT OF USER LICENSE. You have an individual user license for ASP, including any text, graphics, images or photographs contained therein. You have the right to install the plugins on personal and/or business related Wordpress blogs that belong to, or are owned by YOU. You do not have the license to install the plugins on blogs not owned by you. 2. VOLUME RESTRICTION The License is granted for a number of bookmarked posts. The actual maximum number of bookmarked posts depends on the type of license you purchased, as displayed in your account. For instance, the ASP Gold -100,000x is valid up to a MAXIMUM of 100,000 bookmarked posts. EACH and EVERY time ANY post is bookmarked to ANY bookmark account, this will increment the 'bookmarking counter' by ONE (1). The license will cease to be valid once the 'bookmarking counter' has reached 100,000, i.e. once 100,000 posts have been bookmarked. The ASP - Gold - Beta is valid up to a MAXIMUM of 1,000 bookmarked posted. Once you have reached the maximum number of bookmarked posts, you may want to buy a new license or, if available, volume extensions license. 3. COPYRIGHT PROTECTION. ASP (including but not limited to any technology, images, audio, text, and “applets” incorporated into the software product) is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All rights not expressly granted are reserved by Interactive Gambit LLC. This agreement does not convey to you an interest in or to the ASP, but only a limited right to use the ASP, revocable in accordance with the terms of this agreement. The fact that you may or may not have suggested, requested some new features and/or have tested ASP does not give you any title or ownership in our technology or software. All rights to ASP belong solely and exclusively to Interactive Gambit LLC. 4. OTHER RESTRICTIONS. You may NOT modify, network, rent, lease, make derivative works of, or otherwise distribute the Product unless authorized; nor can you make the Product available by "bulletin boards," online services, or network links of any kind; nor can you create similar works based upon the Product or Physical Version in whole or in part. You hereby agree NOT to use ASP to promote: (i) any material that violates any applicable laws, including without limitation the laws of the United States, the laws of any state or commonwealth within the United States, and the laws of any other jurisdiction that may apply; (ii) any material that restricts or inhibits any other user from using and enjoying the Internet; (iii) any material that is considered as SPAM, 'black hat' tactics or contrary to the Internet 'code of conduct'; (iv) any material that is unlawful, threatening, abusive, harassing, defamatory, obscene, offensive, harmful, obnoxious, pornographic, profane, sectarian or indecent, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation; (v) any material that contains viruses or any other element or component that has a capacity or potential to interrupt, destroy, interfere with, permit the unauthorized use of, or limit the functionality of any computer software or hardware, any telecommunications equipment, or any communications network; (vi) any material that violates or infringes the rights of others, including without limitation rights under copyright, trademark, or patent law; rights of privacy or publicity; rights under defamation law; or rights under securities or other applicable law. You hereby agree NOT to post negative comments on our products on any public forum, nor to threaten to do so. You hereby acknowledge and agree that that failure to comply with the above shall result in the immediate termination of the License. Any such termination shall be in Interactive Gambit’s sole discretion and may occur without prior notice, or any notice. 5. SITE UPDATES As a reminder, ASP is used to bookmark blog’s posts to bookmarking sites. Because most if not all bookmarking sites are updating their login/posting process on a regular basis, it may happen from time to time that ASP is unable to post to several bookmarking sites. This is why we try to update the ASP code on a regular basis. Because of this ongoing process, we cannot guarantee that, at any point in time all the bookmarking sites listed in our documentation and/or our website will be properly configured. There could be and there will be posting errors. These posting error could occurred for a number of reasons, including the use of wrong username/password, changes in the login/posting error and/or server time out. While we use reasonable efforts to update the list of bookmarking sites, we are not committed to a minimum number of bookmarking sites and/or to any specific bookmarking sites. We are also entitled to remove existing sites and/or add new sites on a discretionary basis. You are welcome to signal to us any such posting errors you may encounter when using ASP. However, you fully understand and agree with the above. Therefore, you agree NOT to complain, criticize us, blame us and/or request a refund if and when encountering such posting errors. 6. SUPPORT DESK See: http://www.mass-automation.com/legal/support.html By downloading ASP you are agreeing to be bound by the terms & conditions of our support desk. As such, you are entitled to technical assistance in accordance with the terms and conditions of our support desk policy.This includes without being limited to the following: - By requesting assistance from support desk, you agree to waive you right to request a chargeback from your credit card company. If needed, you shall instead request a refund as per our refund policy. Should you make a chargeback request, you agree to indemnify us for any costs, including lawyers fees, incurred when defending ourselves against such chargeback request. - Once you have requested assistance from support desk, you can no longer request a refund provided that support desk resolved the first issue you submitted. - You understand that these rules are to protect us from clients asking us to spend time fixing issues on their server and then requesting a refund and/or a chargeback, leaving assuming the cost of the free support we provided without any corresponding income. 7. REFUND POLICY See: http://www.mass-automation.com/legal/refund.html By downloading ASP you are agreeing to be bound by the terms & conditions of our refund policy. You are entitled to a refund in accordance with the terms and conditions of our support desk policy.This includes without being limited to the following: - Any refund request which does not meet the criteria set out in our refund policy is not valid - Once you have requested assistance from support desk, your right to a refund is limited to cases were support desk is unable to solve the first issue you submitted. 8. LIMITED WARRANTY. THE CREATOR AND SELLER OF THIS SOFTWARE EXPRESSLY DISCLAIM ANY WARRANTY FOR THE SOFTWARE PRODUCT. THE SOFTWARE PRODUCT AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE PRODUCT REMAINS WITH THE END USER. 9. NO DAMAGE LIABILITY. IN NO EVENT SHALL THE CREATOR OR SELLER OF THIS SOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, LOSS OF INFORMATION, BUSINESS INTERRUPTION, OR ANY OTHER LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS PRODUCT. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. 10. GENERAL.
